Sewa Mart – Terms & Conditions

Welcome to Sewa Mart, an online platform owned and operated by IENCODE TECH (“we”, “us”, “our”). By accessing, registering, or using our website, mobile app, or services (collectively, the “Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

If you do not agree to these Terms, you must immediately discontinue use of the Platform.

1. About Sewa Mart

  • Sewa Mart is a digital marketplace connecting Service Providers (Service Ninjas) with Customers (Service Seekers).
  • Sewa Mart is an intermediary under the Information Technology Act, 2000, and does not provide services directly. All services are independently offered and executed by Service Providers.
  • Sewa Mart and IENCODE TECH do not:
    • Guarantee the quality, safety, legality, or timely completion of services.
    • Assume responsibility for payments, disputes, damages, or losses.
    • Act as employers, partners, or agents of Service Providers.

2. Account Registration & User Obligations

  • Create an account with accurate, complete, and updated information.
  • Safeguard your login credentials; activity under your account is your responsibility.
  • Accounts providing false information or violating laws may be suspended, restricted, or terminated.
  • Users must be at least 18 years old to register.

3. Responsibilities of Service Providers

  • Deliver services professionally, with skill and care.
  • Collect payments directly from Customers unless using Sewa Mart’s payment gateway.
  • Maintain valid licenses, permits, and certifications.
  • Not engage in fraud, theft, harassment, misrepresentation, or unlawful activities.
  • Not misuse customer data, personal information, or property.
  • Take responsibility for delays, damages, or losses during service.
  • Disclaimer: Sewa Mart is not liable for fraud, delays, theft, misconduct, criminal acts, negligence, or harm caused by Service Providers.

4. Responsibilities of Customers (Service Seekers)

  • Verify Service Providers’ credentials, reviews, and past work before booking.
  • Communicate service requirements clearly.
  • Ensure safety of self, family, and property at the service location.
  • Secure personal belongings and valuables prior to availing service.
  • Supervise the service directly or via a trusted representative.
  • Not harass or misuse Service Providers’ contact details, images, or credentials.
  • Disclaimer: Any loss, theft, damage, injury, or dispute is the sole responsibility of the Customer.

5. Payments & Refund Policy

  • Payments are primarily handled directly between Service Providers and Customers.
  • Sewa Mart’s payment gateway acts only as a facilitator, not as a guarantor.
  • Sewa Mart is not liable for failed transactions, disputes, or refunds.
  • Refunds follow the policies of the respective payment provider.
  • Customers should resolve payment disputes directly with the Service Provider.

6. Harassment & Misconduct Policy

  • Harassment, abuse, threats, stalking, or discriminatory behavior is strictly prohibited.
  • Misuse of the Platform for illegal or malicious activities may result in termination and legal action.
  • Sewa Mart may report unlawful activities to law enforcement authorities.

7. User Information & Privacy Policy

  • Do not misuse other users’ personal information.
  • Unauthorized data scraping or resale of Platform data is prohibited.
  • Sewa Mart may collect and process data for operations, analytics, and security compliance.
  • User data is not sold; may be shared with law enforcement when required.

8. Prohibited Activities

  • Fraudulent, unlawful, or harmful use of the Platform.
  • Impersonation or misrepresentation of identity.
  • Posting false reviews or misleading information.
  • Attempting to hack, disrupt, or damage the Platform.
  • Misusing intellectual property of Sewa Mart or Service Providers.

9. Liability Disclaimer

  • Platform provided “as is” and “as available”.
  • No guarantees on service quality, reliability, or availability.
  • Sewa Mart not liable for fraud, theft, damages, disputes, or injury.
  • Users assume full responsibility and risk when engaging with Service Providers or Customers.

10. Intellectual Property

All content, trademarks, logos, and designs are the exclusive property of IENCODE TECH. Unauthorized use is prohibited.

11. Indemnification

By using the Platform, you agree to indemnify and hold harmless Sewa Mart, IENCODE TECH, its owners, employees, and affiliates from any claims, damages, legal fees, or disputes arising from your use of the Platform or violation of these Terms.

12. General Policy

  • Sewa Mart may modify, suspend, or terminate the Platform or these Terms at any time.
  • Continued use after changes indicates acceptance.
  • If any provision is invalid, remaining provisions remain enforceable.

13. Termination

  • Accounts may be suspended or terminated for violations, misuse, or unlawful activities.
  • Termination does not relieve users of prior obligations or liabilities.

14. Governing Law & Disputes

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.

Precautions for Service Providers / Service Ninjas

  • Provide services and collect payment directly; Sewa Mart is not responsible.
  • Do not engage in fraud, theft, bad behavior, criminal activities, or harm the customer.
  • Ensure safety of the customer and their property.
  • Do not misuse the platform for illegal services or products.
  • Deliver services on time; failure to do so is the provider’s responsibility.

Precautions for Service Seekers / Customers

  • Verify provider credentials, reviews, and past work before booking.
  • Communicate requirements clearly before confirming a booking.
  • Ensure personal and property safety at the service location.
  • Be present or appoint a trusted representative to supervise the service.
  • Secure valuables before service begins.
  • Do not misuse providers’ contact details or images.
  • Any damage, loss, or harm is the customer’s responsibility.
